Brownville man gets 12 years to life for sexual assault of a child

March 11-- Mar. 11--Timothy A. Ferry, 42, Brownville, was sentenced on Friday in Jefferson County Court after a jury found him guilty on Jan. 30 of predatory sexual assault against a child; first-degree course of sexual conduct against a child; and first-degree sexual abuse.

Ferry was sentenced to 12 years to life on the predatory sexual assault charge, seven years in prison and five years probation for the course of sexual conduct charge, and three years in prison with nine years of probation for the first-degree sexual abuse charge. All sentences will be served concurrently, and he will be required to register as a sexual offender. He was also served with a 16-year stay-away order of protection for both the victim and a witness in the case.

Ferry was arraigned in July following incidents involving a girl younger than 13 years old that occurred between 2007 and 2014. During the trial, the jury found him not guilty of third-degree attempted rape.

Ruben C. Patterson, 28, pleaded guilty to attempted criminal sale of a controlled substance. He admitted that on April 26 of last year he attempted to sell cocaine. He faces a sentence of four years of prison and two years post-release supervision, as well as payment of a $325 surcharge.

Travis Mattice, 30, waived a grand jury indictment and pleaded guilty to attempted third-degree criminal possession of a controlled substance. He admitted that on Aug. 31 of last year he possessed heroin with the intent to sell or distribute it. Mr. Mattice faces a sentence of one year in prison and a year of post-release supervision.

Tod D. Howland, 50, waived a grand jury indictment and pleaded guilty to felony driving while intoxicated and second-degree aggravated unlicensed operation. He admitted to driving while intoxicated on Aug. 20 of last year in the town of Brownville while his license was revoked. He also admitted to a prior DWI conviction from 2017. Mr. Howland faces a sentence of five years probation, a $1,500 fine, and a $550 surcharge, as well as revocation of his license and a requirement for an interlock device.

Joseph F. Wilcox, 32, waived indictment by a grand jury and pleaded guilty to first-degree aggravated unlicensed operation. He admitted that on Nov, 11, 2018, he drove in the town of Lyme on a suspended license and that his license had been suspended 10 times previously.

Miranda A. Ives, 31, pleaded guilty to a misdemeanor, retracting a prior felony plea. On Nov. 27 of last year she pleaded guilty to criminal possession of the precursors to methamphetamine. Ms. Ives was sentenced on Friday to a one-year conditional discharge for the new misdemeanor plea, provided she successfully completes the Bridge program, and a $200 surcharge.

Amber D. Fairbanks, 44, pleaded guilty to a misdemeanor charge of fourth-degree attempted grand larceny. She admitted that between November 2016 and April 2017 she collected unemployment benefits she was not entitled to, totalling $3,161. She was sentenced to a one-year conditional discharge as she had already paid restitution of the funds.

Melanie J. Hulsizer, 49, pleaded guilty to attempted fourth-degree grand larceny and fifth-degree welfare fraud. She admitted that she received more than $1,000 from the Department of Social Services that she was not entitled to. She was sentenced to three years probation and payment of the remainder of the restitution, which as of sentencing was $2,866, and a $200 surcharge.

Peter M. Nelli, Jr. was sentenced to three years of probation and a mandatory surcharge of $200. On Jan. 18 of last year, he pleaded guilty to one count of petit larceny, a misdemeanor, from an Oct. 29 crime in which he stole a wallet and attempted to use stolen credit cards.

Joseph C. Peck, Jr. was sentenced to three years of prison and two years of post release supervision with a Willard mandate and payment of a $325 surcharge, along with forfeiture of any cell phones or money seized. He pleaded guilty on Feb. 8 to third-degree unlawful manufacturing of methamphetamine and fifth-degree criminal possession of a controlled substance.

Kadi Schroy, 20, Watertown, was sentenced to three years of probation and payment of a $200 surcharge. In July 2018, Ms. Schroy was charged with second-degree robbery, third-degree assault and leaving the scene of an accident in connection with an incident in November 2017 in LeRay. Troopers charged that Ms. Schroy and Ormi C. Fermin, 22, took a man's money during an attempted sale of marijuana, driving away while the man's arm was still in the vehicle. It is unclear which of these charges Ms. Schroy was convicted of.

Richard T. Lacomb, 37, was sentenced to up to five years of probation, more than $1,000 in restitution and payment of a $325 surcharge. Last summer, Mr. Lacomb was charged with three felonies: third-degree grand larceny, first-degree falsifying business records and first-degree offering a false instrument for filing, although it is unclear which of these charges he was convicted of.

David P. Nichols was sentenced to time served and up to five years of probation, an unspecified restitution and a $325 surcharge. On Jan. 8 of last year, Mr. Nichols pleaded guilty to fifth-degree criminal sale of a controlled substance.

Shawn Theriault was sentenced to a one-year sentence with time served and payment of a $200 surcharge. He previously pleaded guilty to second-degree promoting prison contraband.

Mark Adams was sentenced to 10 months for a violation of probation, with credit for time served.

Cory A. Merritt, 27, pleaded guilty to violating his probation after he was charged with menacing on Jan. 19. He was sentenced to 10 months with credit for time served.
