Massena man indicted on 53 counts in connection to rape and predatory sexual assault of children

CANTON -- A St. Lawrence County grand jury indicted a Massena man Tuesday on 53 counts connected to years of child rape and sexual abuse.

In the 28-page indictment, Stacey J. LaPorte Jr., 26, of 52 Maple St., Apt. 5, Massena, currently an inmate at Oneida County jail, is charged with three counts of predatory sexual assault against a child and one count of predatory sexual assault, both A-II felonies, 10 counts of first-degree rape, one count of second-degree rape, six counts of third-degree rape, seven counts of first-degree criminal sexual act, seven counts of third-degree criminal sexual act, three counts of first-degree sexual abuse, two counts of attempted first-degree criminal sexual act and five counts of misdemeanor endangering the welfare of a child.

The indictment charges that from on or about the summer 2007 to on or about March 6, LaPorte committed the crimes of rape and criminal sexual act with two females. According to the first 33 counts of the indictment, one of the females was allegedly victimized from the age of 8 until she was 16. The indictment charges that LaPorte began victimizing a second 15-year-old female during the winter of 2015-16 through last March 6.

Moreover, the indictment charges that on or about Valentine's Day weekend 2016, LaPorte provided alcohol to a 15-year-old female and a 12-year-old male before making them engage in anal and vaginal sexual intercourse with him and engage in sexual contact with a second 15-year-old female, both by force.

Within the same indictment, LaPorte is charged -- with a female described as a "Jane Doe" -- with two counts of first-degree criminal sexual act, three counts of first-degree rape, one count of third-degree rape and two counts of first-degree sexual abuse.

It is charged that on or about Aug. 29, 2014, in the county, LaPorte and Jane Doe acted in concert with each other and each twice engaged in oral sex with a 15-year-old female by forcible compulsion. Also on three different occasions that day it is charged that the couple engaged in sexual intercourse with the same 15-year-old female by forcible compulsion. It is also charged that on or about March 6 in the county, LaPorte and Jane Doe engaged in oral sex with a 15-year-old female and then engaged in sexual contact with a different 15-year-old female, both by forcible compulsion.

Following the handing up of the indictment Tuesday, District Attorney Mary E. Rain said it was "the most egregious case in my 33-year career."

"It is alleged that Stacey LaPorte made a brother rape his sister and do other sexual acts to each other," Ms. Rain said. "He is indicted for four separate victims and the thing that makes this egregious is a pedophile usually stays within an age range and particular gender. This defendant went across from infants to teenagers and males and females."

Ms. Rain made reference to the federal case pending against LaPorte. On Oct. 28, LaPorte and Mackenzie Bailey, 20, Massena, were arraigned in Syracuse by U.S. Magistrate Judge David E. Peebles on an indictment alleging they conspired to, and engaged in, the sexual exploitation of minors.

Bailey and LaPorte are charged with conspiracy to sexually exploit a minor child born in 2014 and two counts of sexually exploiting that child on two specific dates in 2016. In addition, LaPorte is charged with a fourth count relating to his alleged exploitation of two children, one born in 2003, the other in 1999, on a specific date in 2016.

Each of the charges filed by the U.S. Attorney's Office against LaPorte and Bailey carries a mandatory minimum sentence of 15 years, a maximum sentence of 30 years in prison, a fine of up to $250,000, and a term of supervised release of at least five years and up to life, as well as registration as a sex offender.

In other grand jury action Monday:

John C. Proetta, 30 of 15 Bay St., Potsdam, is charged with first-degree criminal sexual act.

The indictment charges that on or about the early morning hours of Sept. 10 in or around the village of Potsdam, Proetta engaged in anal sex with a male identified in the indictment only as "JM" while he was physically helpless.

Raymond C. Miller, 44, of 226 Trippany Road, Massena, is charged with failure to register as a sex offender.

The indictment charges that from on or about Oct. 27 through Jan. 6, Miller failed to register an internet account used by him and maintained by Time Warner Cable with the Division of Criminal Justice Services within 10 days.
