2 murder indictments handed down by Morgan County grand jury

April 06--Felony murder indictments were handed down against two Decatur residents by a Morgan County grand jury, the district attorney's office said Wednesday.

Michelle Owens is accused of shooting and killing her husband, and Scott Dutton is charged with shooting and killing a man outside Dutton's home.

Nadis Eugene Carlisle III, the son of former Decatur Police Department captain and interim Police Chief Nadis Carlisle II, also has been indicted -- on two counts of second-degree assault connected to the shotgun shooting of two men in late 2014. Each charge carries up to a 20-year prison sentence if convicted.

Dutton, 34, 606 Eighth St. S.W., was indicted in the June 21 shooting death of Josh McLemore, 27, outside Dutton's home, court records show. Dutton was released from jail on $50,000 bail on March 27. He had been in jail with no bail since his arrest last year before Circuit Court Judge Glenn Thompson reduced his bail in February.

Owens, 45, 2907 Lenox Drive S.W., is charged with killing her husband, Lawrence Eddie Owens, with a single gunshot in their home on June 26. Thompson is considering reducing her $1 million bail, which he set last year after her arrest.

Madison County Assistant District Attorney Melissa Heron signed Nadis Carlisle III's indictment Jan. 12. Madison County prosecutors were assigned to the case after Morgan County District Attorney Scott Anderson recused his office from the case because of personal and professional relationships with the elder Carlisle.

Jackson County Circuit Court Judge John H. Graham was assigned to try the case after all three circuit and all three district judges in Morgan County recused themselves from the case for the same reasons.

Nadis Carlisle II retired from the Decatur Police DepartmentDec. 1 as commander of the Criminal Investigation Division. The senior Carlisle served as interim police chief last year before becoming chief of the Alabama A&M University'sPolice Department in February.

Arraignment for Carlisle III, 29, is set for Aug. 7.

Carlisle III was not among the 113 people listed on the March grand jury indictment list released by the district attorney's office Wednesday afternoon. He was not on the January indictment list released Jan. 20.

Morgan County District Attorney Scott Anderson said he doesn't know why Carlisle's name was omitted from the lists.

"It wasn't intentionally withheld," he said. "The only reason I can contemplate why it wasn't listed is that it was a Madison County case."

Carlisle III was arrested Dec. 23, 2014, in connection with the shotgun shooting of Ricky Dewayne Adams and Tarius Malone in the back parking lot of an apartment complex on Brookline Avenue Southwest the previous night, records show.

Detectives said they found a 12-gauge Remington shotgun and spent shells in a parked car nearby that Carlisle III had been driving.

Carlisle III was released from Morgan County Jail on $5,000 bail the same day he was arrested, records show.
