Man arraigned for domestic abuse

July 23--A 28-year-old Garber man was arraigned Friday on a charge of domestic abuse.

Kenneth Anthoney No Heart appeared Friday before Special District Judge Brian Lovell for arraignment on a felony charge of domestic abuse assault and battery, subsequent offense.

He was charged with a felony because of a prior a domestic abuse misdemeanor charge filed Aug. 29, 2016.

Lovell set the bond for No Heart at $10,000 and ordered him to return to court Aug. 21 for a bond appearance.

According to the affidavit filed for the case, Garfield County Sheriff's Office deputies responded to a call at about 4 p.m. Sunday to a residence in the 300 block of West Ponca in Garber in reference to a domestic dispute.

Deputy Sam Strecker spoke with a woman, who was being treated by Garber Emergency Medical Services for a head injury when law enforcement arrived on scene, according to the affidavit.

When Strecker interviewed her, the woman said she and No Heart were intoxicated and arguing about his parents and him not having a job when he became angry and threw what she believed was an object at her head, according to the affidavit. Strecker then interviewed No Heart, who said they were arguing about him moving out since the woman said the residence was in her name, but he said he paid the bills. No Heart said she pushed him, so he threw a beer can at her. No Heart told deputies the woman "ran across the street to the neighbors." Garber EMS arrived to treat her for a half-inch laceration above her right eye. No Heart was placed in custody for domestic assault at 4:17 p.m.

No Heart faces up to a $5,000 fine and imprisonment for up to four years, if convicted of the charge.
