Babb-Harrison indicted on rape charge

Richmond Register - 9/2/2017

Sept. 02--A former Eastern Kentucky University basketball player was indicted Wednesday on a charge of first-degree rape. Police say Jaylen Babb-Harrison admitted to raping a woman in December in his off-campus apartment.

Police say Babb-Harrison, 24, a native of Ontario, Canada, raped the woman the morning of Dec. 4. The basketball player was arrested that same day, but released two days later after posting a $25,000 bond.

When questioned by police, Babb-Harrison said he regretted his actions and admitted he "crossed the line" and that he "should be held accountable," according to his arrest citation.

The victim told police she did not respond positively to Babb-Harrison's advances or consent to sex with him. She also said he ignored her plea for him to stop, the citation added.

The alleged offense took place at 3:15 a.m. in an apartment in the 300 block of High Street. Babb-Harrsion was placed under arrest at 9:34 a.m. after an interview at the Richmond police station, according to the citation.

First-degree rape is a Class B felony, punishable by up to 20 years in prison.

A Richmond teenager was indicted Wednesday on charges of rape, sodomy and incest after police say he engaged in sexual intercourse by forcible compulsion with two minor female family members.

James Flenner, 17, no image available, is being tried as an adult in the case, Madison Commonwealth Attorney David Smith said.

Flenner was indicted by a Madison County grand jury on charges of first-degree rape (two counts), first-degree sodomy, incest (three counts), first-degree sexual abuse (three counts) and attempted first-degree sexual abuse relating to the alleged acts, which the indictment states occurred between September 2015 and Feb. 27, 2017.

The sexual abuse charges stem from Flenner allegedly touching the girls inappropriately; the attempted sexual abuse charge stems from Flenner allegedly trying to force one of the girls to touch his genetalia.

If convicted, Flenner could be sentenced to up to 135 years in prison on the charges.

A 74-year-old Berea man was indicted on child pornography charges for allegedly watching the material on a public computer at the library in Berea.

Larry A. Miller, of Arrowhead Drive, Berea, was arrested in June after police say he was looking at children between the ages of 7 and 12 engaging in sexual acts with an animal on the library's computer. A juvenile was sitting at a table directly behind Miller and had a clear view of the screen, according to an arrest citation.

Miller was indicted by a grand jury on a Class D felony charge of viewing matter portraying a sexual performance by a minor, and a misdemeanor charge of distribution of obscene matter to a minor. Class D felonies are punishable by one to five years in prison.

An indictment does not indicate guilty, only that the grand jury believes the state has enough evidence to prosecute.
