Minneapolis man pleads guilty to assault over music

Austin Daily Herald - 9/5/2017

Sept. 05--A man who attacked a woman after she told him to turn his music down pleaded guilty on Friday in Mower County District Court.

Calvin Curtis Horton, 37, of Minneapolis was convicted of felony domestic assault. He pleaded guilty as part of a plea agreement.

According to the court report, officers responded to a domestic assault call on July 30, 2016, in the 900 block of 11th Avenue Southwest. They found two women standing outside the residence, while Horton was standing on the front steps of a residence in the 1000 block.

One of the woman told police that she was in bed at the residence in the 1000 block while Horton was playing his music. She told him to turn it down. Horton, who was intoxicated, came into her room, pulled the blanket off of her and knocked something over. He then started grabbing and pulling her. She pulled him onto the bed and he reached for her phone. She told him to leave and he scratched her on the neck. She then left the residence and came to the neighbor's house.

An officer shined the flashlight on her neck and saw it was very red. She also had scratch marks on the back of her forearm.

The victim said Horton had assaulted her in the past.

Officers found Horton at her residence, yelling down the street at her and playing music on his phone. He initially refused to speak with the officers or shut off his music. When he did speak to the police, he told them they had gotten into an argument and she had gone down the street.

Horton has prior convictions for fifth-degree assault and felony domestic assault.

Horton is scheduled to be sentenced on Jan. 19.
