Cases resolved in Cheshire County Superior Court

Feb. 03--Judge David W. Ruoff of Cheshire County Superior Court in Keene sentenced a man to prison recently after the man pleaded guilty to possessing child pornography.

Keith D. Bubar, 51, who is listed in sentencing documents as homeless, pleaded guilty to felony possession of child sex abuse images in Keene in July. He was sentenced to 1 1/2 to seven years in N.H. State Prison and credited with 154 days served while awaiting resolution of his case.

Others recently sentenced include:

Brandon Labrie, 33, whose address is listed in sentencing documents as the county jail, pleaded guilty to felony burglary in Swanzey in October 2016. According to the documents, he illegally entered a Spring Street residence with the intent to commit theft. He was sentenced to 360 days in jail, with 90 days suspended for four years and credited with 98 days served while awaiting resolution of his case. He will be placed on probation for three years upon his release, and he was ordered to pay $795.42 in restitution and to have no contact with his victim.

Labrie also pleaded guilty to theft by unauthorized taking with two prior convictions, a felony, in Swanzey in November 2016. According to sentencing documents, he stole a DVD player and coins from the same residence he'd burgled the previous month and had previously been convicted of felony theft by unauthorized taking in October 2010 and September 2011. He was sentenced to 1 1/2 to three years in N.H. State Prison, all suspended for five years and consecutive to the previous sentence. He was ordered to have no contact with his victim and to not be at his property.

Prosecutors dismissed a misdemeanor criminal trespass charge.

Joshua T. Andrews, 23, who is listed in sentencing documents as homeless, pleaded guilty to attempted sale of crack cocaine, a felony, in Keene in September. He was sentenced to 12 months in jail, with six months suspended for three years, and credited with 108 days served while awaiting resolution of his case. He will be placed on probation for two years upon his release, and he was ordered to pay $434 in fines and penalties. He was also ordered to tour the state prison. Felony charges of sale of crack cocaine and possession of crack cocaine with intent to sell were dismissed by prosecutors.

Schuyler Cumback, 28, of Newport pleaded guilty to conspiracy to possess crack cocaine, a felony, in Keene in October. She was sentenced to one to three years in state prison, all suspended for three years, and placed on probation for two years. She was ordered to pay $434 in fines and penalties, all suspended for three years.

Nathan Kenyon, 31, of Keene pleaded guilty to violating his probation in December on a January 2017 conviction for heroin possession. He was sentenced to four months in jail and credited with 38 days served while awaiting resolution of his case. He is eligible to have the balance of his sentence suspended if he completes an intensive outpatient program.
