Ames man trying to overturn sexual assault guilty plea

June 08--The Ames man, who pleaded guilty this spring to assaulting a woman in October 2016, is trying to overturn his plea, after claiming that he was not made aware of the requirements of the sexual assault registry, according to court documents.

Clarence Castile, 34, pleaded guilty to assault with intent to commit sexual abuse.

Castile was arrested in August 2017 and charged with third-degree sexual abuse and assault with intent to commit sexual abuse. He pleaded guilty April 18.

According to court documents, on Oct. 14, 2016, the victim contacted Ames police to report she was sexually assaulted by a man, whom she identified as Castile.

The victim alleged in court documents that Castille was at her residence, where he exposed himself to her and forced her to touch him inappropriately. Documents also allege that Castile asked the victim to perform sexual acts on him.

In court documents, Castile claims that if his attorney at the time would have informed him about all the requirements of the sex offender registry, he never would have agreed to plead guilty.

Castile alleges that his attorney did not fully inform him of these restrictions, rendering his guilty plea involuntary due to not having a full understanding of the consequences of his actions.

According to the Iowa Sex Offender Registry, convicted sex offenders cannot live within 2,000 feet of a school or daycare center and cannot work at a facility providing services to dependent adults or minors.

Castile's attorney Bryan Barker could not provide details on the exact restrictions Castile referenced and declined to comment further on the case.

Barker filed a motion to overturn Castile's plea, as well as a motion to withdraw as counsel, last week.

A hearing on the motion is scheduled for July 2.
