Man accused of sex crimes against minor bound for trial

McAlester News-Capital - 8/11/2018

Aug. 11--A McAlester man accused of sex crimes against a minor has been bound over for trial, according to court documents.

Allen Wayne Gragg, 60, of McAlester, was originally charged July 2 with one count of felony first-degree rape, according to documents filed by the office of District 18 District Attorney Chuck Sullivan.

Court records show the DA's office was granted a motion to amend charges against Gragg during an Aug. 8 preliminary hearing to add seven counts of felony child sexual abuse and one additional count of felony first-degree rape.

Pittsburg County Special District Judge Mike Hogan gave the DA's office five days to amend the information sheet against Gragg to reflect the additional charges. The amended information sheet was not available at press time Friday.

Gragg faces district court arraignment at 10 a.m.Aug. 22 in front of Pittsburg County Associate District Judge Tim Mills and remained out on a $25,000 bond that was posted July 7 on the condition that he has no contact with the alleged victim.

According to court documents, the alleged victim -- who is now older than 18 -- told a deputy in May that Gragg raped her when she was 11 years old and that he continued to rape her over a period of years.

In the report that was prepared by Pittsburg County Sheriff's Deputy Alena Ashalintubbi, the alleged victim gave the deputy multiple locations where she was allegedly raped by Gragg, including at a church camp where he mowed the grass.

Ashalintubbi wrote in her report that she spoke with Gragg on June 29 at the Pittsburg County Sheriff's Department.

Gragg was read his Miranda warning by Ashalintubbi before he signed a waiver, stated that he understood his rights and that he would speak with the deputy, the affidavit states.

The deputy wrote in her report that Gragg admitted to her that he had sex with the alleged victim and that the first time he could remember was when the alleged victim was 15 and that they had sexual relations several different times over the years.

Questions were raised over the paternity of a child of the alleged victim in which Gragg told the deputy that he and the alleged victim had sex two to three times after the child was born, the affidavit stated.
