Indianola man charged with domestic abuse

Sept. 25--An Indianola man was arrested and charged after allegedly beating a woman to the point that she told her mother "she thought she was going to die."

Andy Smith, 32, was charged Sept. 17 with felony kidnapping, felony domestic abuse and battery with a dangerous weapon and misdemeanor domestic abuse -- assault and battery, according to documents filed by the office of District 18 District Attorney Chuck Sullivan.

Court records show Smith posted a $50,000 bond through a bondsman after his initial appearance Sept. 17 under the condition of having no contact with the alleged victim.

According to a probable cause affidavit prepared by Pittsburg County Sheriff's Deputy Tommy Lyons, the deputy was dispatched to the Dollar General in Canadian for a report of a woman that had been badly beaten and the store clerk had her locked in the office to keep her from the suspect.

Lyons wrote once he arrived at the store, the suspect was no longer at the store and was seen driving south on U.S. Highway 69, the affidavit states.

The deputy spoke with the store clerk who told the deputy the victim was in the bathroom and another woman was trying to get her to leave, which turned out to be a family friend that was trying to keep her safe until the deputy arrived, the report states.

According to the affidavit, the victim told Lyons she did not want to press charges on her husband because "it was all her fault." Lyons wrote in his report he assured her it was not her fault and that she needed to tell him what had happened.

Medics from Pafford EMS arrived on scene and the victim refused medical treatment, the affidavit states.

Lyons wrote in his report he observed injuries to the woman's left hip area, face, eyes, with bleeding and swelling lips, as well as her eyes swelling shut.

The victim told Lyons that she and Smith had gotten into an argument the night before and he got "really angry and busted up everything in the house," the affidavit states. She also told the deputy that Smith took her keys to her car and broke her cell phone by throwing it through a cabinet, the report states.

Lyons was asked to follow the victim and her friend to a residence so the victim could get clean clothes and could clean and treat her wounds, the report states. After arriving, the friend told the deputy that the victim also had injuries to her chest and ribs along with a hand that was swelling up, the affidavit states.

The deputy spoke with the victim's mother on the phone after she arrived at her daughter's location and she told the deputy that the victim had told her Smith had run her head through the wall and that he had smashed the kitchen chairs and was going to hit the victim with a chair, but instead hit the treadmill, the affidavit states.

Lyons wrote in his report the mother told him that the victim told her that at one point "she thought she was going to die."

Smith was contacted and was told to turn himself in which he did and declined to make a statement after being read his Miranda warning, the affidavit states.

Photos of Smith's hands were taken by Lyons after he observed Smith's hands to be scratched, the affidavit states.

Lyons wrote in his report that he asked Smith how he got the injuries to his hands and Smith replied, "I think you know."

The deputy wrote in the report he will try and retrieve video from the Dollar General and will submit it as evidence at a later time, the report states.

Documents show Smith is scheduled for a preliminary hearing conference at 8:30 a.m.Sept. 28.
