Felony court cases for Oct. 2

Oct. 03--The following cases were among those heard at an Oct. 2 felony court session at the Davison County Public Safety Center.

--Terry Gleason, 37, of Mitchell, pleaded guilty to failure to register as a convicted sex offender, a Class 6 felony which carries a maximum penalty of two years in the state penitentiary and a fine of $4,000; Sentenced to two years in the state penitentiary with two years suspended, two years probation and credit for four days served; Must pay a fine of $750 and $106.50 in court costs; Must repay court-appointed attorney's fees.

--Rachelle Cade, 43, of Mitchell, pleaded guilty to possession of a controlled substance, to wit, methamphetamine, and unauthorized ingestion of a controlled substance, to wit, methamphetamine, both of which are Class 5 felonies which carry a maximum penalty of five years in the state penitentiary and a fine of $10,000; Sentenced to two concurrent five-year sentences in the state penitentiary with five years suspended on each, four years probation and 45 days in jail with credit for 17 days served; Must pay restitution, a fine of $1,000, $106.50 in court costs and $100 in testing costs

--Joseph Davis, 45, of Mitchell, pleaded guilty to a third-offense DUI, a Class 6 felony which carries a maximum penalty of two years in the state penitentiary and a fine of $4,000; Sentenced to two years in the state penitentiary with two years suspended, two years probation and 30 days in jail with credit for 23 days served; Must pay a fine of $750, $140 in reimbursement for a blood test, $106.50 in court costs and a $50 DUI fee; Must repay court-appointed attorney's fees.

--Laycee St. John, 27, of Mitchell, failed to appear on charges of unauthorized ingestion of a controlled substance in schedules I or II, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000, and possession of two ounces of marijuana or less, a Class 1 misdemeanor which carries a maximum penalty of one days in jail and a fine of $2,000; Court issued a $1,000 bench warrant.

--Zachary Raborn, 30, of Mitchell, denied violating probation for a previous conviction of possession of a controlled substance in schedules I or II, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000; Status hearing scheduled for Oct. 9.

--Brandi Anderson, 19, of Mitchell, pleaded guilty to possession of more than two ounces and less than one half pound of marijuana, a Class 6 felony which carries a maximum penalty of two years in the state penitentiary and a fine of $4,000; Sentencing scheduled for Oct. 30.

--Justin Schinabeck, 27, of Mitchell, pleaded guilty to possession of a controlled substance, to wit, methamphetamine, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000; Sentencing scheduled for Oct. 30.

--Andrew Engles, 24, of Mitchell, pleaded guilty to possession of a controlled substance, to wit, delta nine tetrahydrocannabinol, and distribution of more than one ounce but less than one half pound of marijuana, both of which are Class 5 felonies which carry a maximum penalty of five years in the state penitentiary and a fine of $10,000; Pleaded guilty to possession with intent to distribute one ounce or less of marijuana, a Class 6 felony which carries a maximum penalty of two years in the state penitentiary and a fine of $4,000; Admitted to violating probation for a previous conviction of domestic abuse, fourth-degree rape of a child 13 but less than 16 years of age, a Class 3 felony which carries a maximum penalty of 15 years in prison and a fine of $30,000; Sentencing scheduled for Nov. 13.

--Kevin Freeman Jr., 37, of Baltimore, Maryland, pleaded not guilty to possession with intent to distribute one pound or more of marijuana, a Class 3 felony which carries a maximum penalty of 15 years in prison and a fine of $30,000, possession of a controlled substance in schedules I or II, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000, and possession of two ounces or less of marijuana, a Class 1 misdemeanor which carries a maximum penalty of one year in jail and a fine of $2,000; Status hearing scheduled for Nov. 13.

--Jeffery McGhee, 45, of Mitchell, admitted to violating probation for a previous conviction of possession of a controlled substance in schedules I or II, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000; Sentenced to five years in the state penitentiary with five years suspended, four years probation and 143 days in jail with credit for 136 days served; Must repay court-appointed attorney's fees and any previously ordered amounts.

--William Mayes, 34, of Mitchell, failed to appear on charges of manufacturing, distribution or possession of drugs in schedules I or II, a Class 4 felony which carries a maximum penalty of 10 years in the state penitentiary and a fine of $20,000, possession of a controlled substance in schedules I or II and being an accessory to a felony, both of which are Class 5 felonies which carry a maximum penalty of five years in the state penitentiary and a fine of $10,000, and possession of two ounces of marijuana or less, a Class 1 misdemeanor which carries a maximum penalty of one year in jail and a fine of $2,000; Court continued a no-bond bench warrant.

--Elizabeth Thunderhawk, 26, of Rosebud, was sentenced to five years in the state penitentiary with two years suspended and credit for 62 days served for possession of a controlled substance in schedules I or II, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000; Must pay $108 in prosecution costs and $106.50 in court costs; Must repay court-appointed attorney's fees.

--Michael Goodbeau, 41, of Miller, admitted to violating probation for a previous conviction of aiding and abetting third-degree burglary, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000; Continued to Oct. 9.

--Kyle Nunez, 24, of Mitchell, admitted to violating probation for a previous conviction of unauthorized ingestion of a controlled drug or substance in schedules I or II, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000; Sentenced to five years in the state penitentiary with five years suspended, two years probation and credit for 36 days served; Must pay all previously ordered amounts; Must repay court-appointed attorney's fees.

--Kristal Simpson, 41, of Benson, Minnesota, pleaded guilty to possession of a controlled substance in schedules I or II, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000; Sentenced to five years in the state penitentiary with five years suspended, four years probation and 39 days in jail with credit for 32 days served; Must pay a fine of $1,000, $120 in testing costs and $106.50 in court costs; Must complete treatment program; Must repay court-appointed attorney's fees.

--Timothy Bingham, 57, of Mitchell, was sentenced to five years in the state penitentiary with three and a half years suspended and credit for 23 days served; Must pay a fine of $1,000, $178.60 in prosecution costs and $106.50 in court costs; Must repay court-appointed attorney's fees.

--Jack Powers, 20, of Mitchell, pleaded not guilty to possession of a controlled substance in schedules I or II, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a fine of $10,000, possession of two ounces of marijuana or less and ingesting an intoxicant other than an alcoholic beverage, both of which are Class 1 misdemeanors which carry a maximum penalty of one year in jail and a fine of $2,000, and use or possession of drug paraphernalia, a Class 2 misdemeanor which carries a maximum penalty of 30 days in jail and a fine of $500; Jury trial scheduled for Feb. 11

--James Heginger, 19, of Mitchell, pleaded guilty to fourth-degree rape of a child at least 13 but not 16 years of age, a Class 3 felony which carries a maximum penalty of 15 years in prison and a fine of $30,000, and possessing, manufacturing or distributing child pornography, a Class 4 felony which carries a maximum penalty of 10 years in the state penitentiary and a fine of $20,000; Court ordered a pre-sentence report and psychosexual evaluation; Continued to Jan. 22.

--Josiah Sinkie, 36, of Mitchell, pleaded guilty to more than two ounces but less than one half pound marijuana, a Class 6 felony which carries a maximum penalty of two years in the state penitentiary and a fine of $4,000, and carrying a handgun without a permit, a Class 1 misdemeanor which carries a maximum penalty of one year in jail and a fine of $2,000; Sentencing scheduled for Oct. 30.
