INDICTMENTS: Three indicted in sexual abuse case involving children

Dec. 19--Two men and a woman were indicted by a grand jury on Dec. 4 on abuse and sexual abuse charges involving children younger than 12 after a victim said they didn't feel safe around one of the men because he sexually abuses them.

In early October, several children were interviewed, and one of them (Victim 1) said they never feel safe around CV Rose, 36, Race Street, Richmond, because he sexually abuses them, according to Rose's citation.

Victim 1 said Rose would threaten to take things away from Victim 1 or not buy Victim 1 things if they didn't do what he asked of them, or if they told anyone what happened, Rose's citation states.

When asked if he thought Victim 1 was lying, he wouldn't say that Victim 1 was lying, only that "'I do not know where (they) got that from,' or 'I do not know why (they) would say that,'" the citation reads. He said if anything ever happened, it was an accident.

When officers spoke with Valerie Spivey, 32, Race Street, Richmond, who said she got jealous of Victim 1, because Victim 1 "was getting all of the attention from her husband," her citation states.

Spivey, who is married to Rose, said she has seen Rose grab Victim 1 inappropriately about 30-40 times, according to his citation. However, Spivey told police she didn't want to believe it and didn't want her husband to get in trouble. She said she also never said anything to Rose about it.

Also during the interview, another child (Victim 2) said Rose would spank them with his hand and belt causing marks and bruises, his citation continues.

Additionally, Spivey said she had suspicions of Rose's brother, Brandon Sparks, 27, Race Street, Richmond, sexually abusing Victim 2 and another child who was interviewed (Victim 3).

According to Sparks' citation, Victim 3 said they were scared of Sparks "'because he touches me.'"

Victim 3 had previously said Sparks touched them inappropriately, but he wasn't charged. Instead, a prevention plan was put in place stating he wasn't allowed near the children alone, but Spivey said she never followed it.

Rose is charged with two counts of first-degree rape (vulnerable victim, victim younger than 12), two counts of incest (vulnerable victim, victim younger than 12), attempted first-degree sodomy (vulnerable victim, victim younger than 12), four counts of use of a minor in sexual performance, four counts of first-degree sexual abuse (vulnerable victim) and first-degree criminal abuse.

Spivey is charged with three counts of first-degree criminal abuse.

Sparks is charged with first-degree sexual abuse (vulnerable victim, victim younger than 12).

The grand jury also indicted Sheldon Muncy, 48, Walker Park Road, Richmond, on charges of first-degree sexual abuse (vulnerable victim, victim younger than 12), first-degree sexual abuse (vulnerable victim) and first-degree sexual abuse.

He was arrested in late September after Madison County deputies went to his home, according to a previous Register article.

When they arrived, Muncy was sitting on the front porch, and deputies asked if he knew why they were there, according to a citation. He responded with, "Yes, because (the victim) said I was doing things to (them)."

The victim, the citation states, had said Muncy woke them up to take some medicine twice and to lay in another person's bed. They said they woke up later without clothes on, and Muncy was touching them inappropriately.

As he was being arrested, Muncy said he thought the victim was someone else and that his wife wasn't home, the citation states. He smelled of alcohol and had bloodshot eyes and slurred speech. A breath test showed his alcohol level at 0.234.

The following were also indicted on Dec. 4:

--Darrell Allen, age and address unknown, first-degree controlled substance trafficking (more than 2 grams of methamphetamine), first-degree controlled substance trafficking (LSD), possession of drug paraphernalia and second-degree persisting felony offender.

--Angela Sproles, 34, Hager Drive, Richmond, first-degree controlled substance trafficking (less than 2 grams of methamphetamine), marijuana trafficking (less than 8 ounces), possession of drug paraphernalia, failure to use a turn signal, failure of non-owner operator to maintain required insurance and no/expired registration receipt.

--Benjamin Partin, age and address unknown, first-degree controlled substance trafficking (less than 2 grams of methamphetamine), controlled substance trafficking (fentanyl), controlled substance trafficking (heroin), marijuana trafficking (less than 8 ounces), first-degree promoting contraband, possession of drug paraphernalia and marijuana possession.

--Tyler Cheeks, 20, Salter Road, Berea, first-degree controlled substance trafficking (less than 2 grams of methamphetamine), convicted felon in possession of a handgun, marijuana trafficking (less than 8 ounces), possession of drug paraphernalia, giving an officer a false name and second-degree persistent felony offender.

--Gerri Kindred, age and address unknown, first-degree controlled substance trafficking (less than 2 grams of methamphetamine), convicted felon in possession of a handgun, marijuana trafficking (less than 8 ounces), possession of drug paraphernalia, giving an officer a false name and second-degree persistent felony offender.

--Phong Tang, 48, Mahaffey Drive, Richmond, first-degree promoting gambling.

--Trang Nguyen, age and address unknown, first-degree promoting gambling.

--Hung Nguyen, age and address unknown, first-degree promoting gambling.

--Patsy McBride, 58, Amberly Way, Richmond, first-degree promoting gambling.

--Ivan Tsotigh, 40, Cobble Dr., Richmond, three counts of carrying a concealed weapon by prior deadly weapon felony offender and no operators license.

--Vishalkumar Patel, age and address unknown, first-degree promoting gambling.

--Ketan Patel, age and address unknown, first-degree promoting gambling.

--Paul True, 28, Marcellus Drive, Berea, first-degree fleeing or evading police, reckless driving, disregarding a traffic control device, improper passing, operating on a suspended or revoked license and first-degree persistent felony offender.

--Lisa Little, age and address unknown, false statement to obtain benefits over $100 and fraudulent use of ID card of electronic code for benefits.

--Jeremiah Wilson, 32, Louisville, first-degree controlled substance possession and possession of drug paraphernalia.

--James Hicks, 42, Slate Lick Road, Berea, two counts of first-degree controlled substance possession and two counts of possession of drug paraphernalia.

--Katrin Ellington, age and address unknown, first-degree bail jumping.

--Jessy Register, age and address unknown, first-degree bail jumping.

--Ryan O. Clark, 28, unknown address, first-degree bail jumping.

An indictment does not indicate guilt, only that grand jurors believe the state has enough evidence to proceed with prosecution.
