Lubbock man in 2019 standoff sentenced to 43 years in prison

A 25-year-old man on Wednesday was sentenced to 43 years in prison for sexually abusing a 7-year-old girl in 2019 and recording it.

Andrew Ybaben appeared in-person with his attorney, Matt Morrow, at the 137th District Court to enter his plea to a first-degree felony count of aggravated sexual assault of a child. He faced between five years to life in prison.

A second count of indecency with a child was dismissed as part of his plea.

His sentence will run concurrent with a 25-year federal prison sentence handed to him in December in a related case charging him with production of child pornography.

He will also have to register as a sex offender for life.

Ybaben was arrested in July 2019 after a two-hour long standoff with authorities at a South Lubbock apartment. He reportedly barricaded himself at his apartment in the 1300 block of 65th Drive when U.S. Marshals tried arresting him on a warrant for aggravated sexual assault of a child. Lubbock County Sheriff's officials said Ybaben locked himself in a bathroom and threatened to kill himself if the marshals tried entering.

The sheriff's special weapons and tactics team arrived and blocked off the roads to the apartment complex until Ybaben surrendered two hours later.

Ybaben's charges stem from a Lubbock police investigation that began when a 7-year-old girl's mother reportedly told Lubbock police in June 2019 that she found concerning images of her daughter on Ybaben's phone, the complaint states.

The videos showed Ybaben sexually assaulting the girl, who was a family member, while she slept. The videos had May timestamps, the documents state.

He also had pictures of her in the bathroom while bathing, the documents state.

The girl told her mother Ybaben entered the bathroom while she was in the shower to use the toilet and told her to turn away from him. She believes this is when he took the pictures, the documents state.
